Kaspersky “Touchdowns for Technology” Sweepstakes (the “Sweepstakes”)
Official Rules

YOUR CHANCE OF WINNING A PRIZE.
1) Sweepstakes Period: The Sweepstakes Period is from 12:00:01 am, Eastern Time (ET) August 14, 2009 ("Sweepstakes-Start") to11:59:59 pm, ET December 28, 2009 ("Sweepstakes-End"). Sponsor’s website clock will be the official timekeeper for this Sweepstakes for all purposes.
2) Eligibility: This Sweepstakes is open only to legal, U.S. residents residing in the 48 contiguous United States and D.C., but excluding residents of – and the Sweepstakes is void in – New York, Florida, Puerto Rico, other US territories and where prohibited, licensed, restricted or taxed. The following individuals are NOT eligible to enter or be awarded a prize: employees, officers and directors, and members of their immediate families (spouse, parents, children, siblings and each of their spouses regardless of where they live) and households, of Kaspersky Lab (“Sponsor”), WBZ-FM, THE MARKETING AGENCY, LLC (“Administrator”) and their respective parent companies, subsidiaries, advertising, design, web design, web hosting and promotion and publicity agencies and anyone connected with the production or distribution of this Sweepstakes (the “Sweepstakes Entities”).
3) How to Enter: This Game is played only on the Internet. All entrants from Maine must be 18 years of age or older to enter this Sweepstakes. Go to touchdownsfortechnology.com and if you are 13 years of age or older (except residents of Maine, who must be 18 to participate), complete the entry form with your name, daytime phone number, a valid working email address for which you are the Authorized User (defined below), and the name of a school situated in the six (6) New England states (CT, MA, ME, NH, RI & VT) that you wish to support (and your affiliation with that school, if applicable). If you are under 13 years of age (except residents of Maine, who must be 18 to participate), you may only supply an email address for which you or a parent/guardian are the Authorized User and the name of the school situated in the six (6) New England states that you wish to support. Your email address will only be used to contact you or your parent/guardian if you are a winner and it will be destroyed at the conclusion of this Sweepstakes. Maximum one (1) entry per person or email address during the Sweepstakes Period. All non-winning entries will be rolled over to subsequent drawings in this Sweepstakes so there is no need to enter this Sweepstakes more than once. A potential prize winner will be notified by email, or phone, in Sponsor’s sole discretion so it is entrant’s responsibility to keep his/her email address, and daytime phone current to see if s/he is a potential winner. An email “Authorized User” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the email address. In the case of a dispute regarding who submitted a particular entry, the entry will be deemed submitted by the name of the Authorized User associated with that email address.
4) Winner Selection: One (1) Grand Prize potential winner will be chosen each week, for 16 weeks, in random drawings from all eligible entries received from Sweepstakes-Start to 11:59:59 pm of the Sunday immediately prior to the drawing. If a potential winner does not respond to Sponsor’s notification (as detailed in #3 above) within three (3) business days and agree to accept the prize and provide his/her mailing address, that entry shall be disqualified and that potential winner’s prize forfeited, and an alternative potential winner will be selected in random drawings from the remaining eligible entries in the Sweepstakes. This procedure will continue for at least four (4) attempts until a potential eligible winner is found who accepts the prize in question and completes all paperwork requested by the Sweepstakes Administrator. If after four (4) attempts to find an eligible weekly prizewinner no entrant is found to accept the Grand Prize, the Administrator may elect either to continue drawing or not to award a prize for that week.
5) Quantity, Prize, Approximate Retail Value (ARV) and Odds: (16) Grand Prize: Each weekly winner will receive: One (1) autographed New England Patriots jersey (Stephen Gostkowski), one invitation for the winner and two (2) guests to attend a “kickers clinic” – two (2) hours in length plus lunch at an offsite location in the Boston, MA area sometime in March, 2010. The school that the winner supported in his/her entry will receive one (1) PC for each touchdown the New England Patriots score in their next scheduled game. (For example, if the Patriots score three (3) touchdowns, the school would be awarded three (3) PCs.) If no touchdowns are scored by the Patriots during the game, one computer will be awarded. A PC will consist of an HP Pavilion p6120t PC or a PC of Sponsor’s choosing of a similar dollar value plus a three year subscription to the current Kaspersky Lab Internet Security Software. ARV: - $400. The prize is awarded “as is” and a winner acknowledges that Sweepstakes Entities have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize or regarding the use, value or enjoyment of the prize. Should winner and/or guests not be able to travel to the kickers clinic on the dates offered by Sponsor, that portion of the prize will not be awarded and will be forfeited forever and the prize or its value will not be replaced. Odds of winning: Depend on the total number of eligible entries received from Sweepstakes-Start to the weekly drawing date in question (see rule #4 above). Each Grand Prize will be awarded if properly claimed according to the Official Rules.
6) General: Sweepstakes administration and winner verification will be supervised by THE MARKETING AGENCY, LLC, the Administrator and independent judging organization, whose decisions are final and legally binding. Entrants waive the right to contest any decision by Sponsor or the Administrator concerning any aspect of the Sweepstakes or the interpretation of the Official Rules or the determination as to the qualification of entries. By participating in this Sweepstakes, you agree to be bound by these Official Rules. The Sweepstakes Entities are not responsible for those who cannot access the Internet or cannot click-through for any period of time regardless of the cause, including technical, hardware, software, telephone, Internet, network problems or virus contamination; of for delay, failure or malfunction for any reason; or for delays or problems due to typographical or system errors or human error, including, but not limited to, errors by the Sweepstakes Entities and their representatives who enter incorrect information into any of Sponsor’s systems; or for force majeure. Sponsor reserves the right to cancel/terminate the Sweepstakes if in Sponsor’s sole determination it believes that the integrity of the Sweepstakes has been, or could be, compromised or that the Sweepstakes is not capable of running as planned or fairly. A weekly winner will be drawn from eligible entries received up to the time of cancellation/termination and no further drawings will take place. Sponsor reserves the right to disqualify any entry from the Sweepstakes if in Sponsor’s sole judgment the entrant has not complied with these Official Rules. Only the prizes listed and the values listed in the Official Rules shall be awarded. A weekly Grand Prize winner, or a parent/guardian if the winner or the winner’s guest is a minor, will be required to execute and return an Affidavit of Eligibility, Liability and Publicity Release within three (3) business days of the date of notification for each person attending the kicker’s clinic or it will be concluded definitively that the prize has been declined and, without further notice, that portion of the prize will be forfeited without further compensation. All minors traveling to the kicking clinic will have to be accompanied by a parent or adult guardian. The right to receive the prize is non-assignable and non-transferable and no prize substitution, transfer, exchange or cash equivalent will be allowed, except that Sponsor reserves the right to substitute a prize (or portion of prize) of equal or greater value. Prize or prize notification that is returned as undeliverable will disqualify the winner and, in the discretion of the Administrator, an alternative winner may be selected in a random drawing.
7) Waiver of Liability: By entering this Sweepstakes, a participant explicitly releases, discharges and holds harmless the Sweepstakes Entities, their shareholders, successors and assigns, one and all, from any and all liability, actions, causes of action, damages, actual, incidental or consequential, claims and demands whatsoever in law or equity, including all “costs”, which s/he now has or may acquire, by reason of any personal injury, death, loss of or damage to property, or any reason, occurring during or arising out of his/her participation in the Sweepstakes and the acceptance and use or misuse of a prize. A prizewinner waives the right to 1) assert as a cost of winning the prize any and all costs of verification and redemption or travel to redeem said prize, and 2) claim any liability (including attorney's and experts’ fees and costs) which might arise from redeeming or seeking to redeem said prize, including travel. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages or for personal injury or property damage, so the above may not apply to you.
8) All laws apply. If any provision of the Sweepstakes shall be deemed to violate any federal, state or local law, regulation or ordinance, it shall be amended to conform to such law and all other provisions shall remain in full force and effect. If Sponsor is required by applicable federal, state or local law, regulation or ordinance, or by action of an administrative agency to cease offering the Sweepstakes in any jurisdiction, Sponsor reserves the right to (i) terminate the Sweepstakes in such jurisdiction in its entirety, and/or (ii) cancel and remove from participation in the Sweepstakes any and/or all entries from entrants residing in such jurisdiction, without penalty and without obligation to any Sweepstakes entrant. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. All taxes are a winner’s responsibility.
9) Publicity: Acceptance of the prize constitutes permission to use the winner's name, voice and likeness and any and all identifying characteristics (excluding phone number, address and email address) including, but not limited to, the taking of photographs and/or videos by Sponsor's photographer/videographer or Sponsor’s request for a photograph, for publicity purposes, and to own all results thereof, without further consent or compensation, unless prohibited by law, and winner agrees to execute any and all documents requested by Sponsor to convey such rights. Nothing shall obligate Sponsor to make use of any of the rights granted herein and winner waives any right to inspect or approve any such use of any and every nature and kind. If the winner is a minor, permission for the above will have to be received from a parent/guardian.
10) No responsibility for Errors: The Sweepstakes Entities shall not be responsible for technical, pictorial, typographical or editorial errors or omissions in any marketing materials or these Official Rules.
11) Entries will be owned by Sponsor: All entries submitted become the property of Sponsor and none will be acknowledged or returned. Sponsor and Administrator collect personal information from you when you enter the Sweepstakes. The information collected is subject to the Sponsor’s Privacy Policy which can be found by clicking “Privacy Policy” at http://usa.kaspersky.com/privacy/ and Administrator’s Privacy Policy found by clicking “Privacy Policy” at http://themarketingagency.com/html/sweepstakes.html. By participating in the Sweepstakes, entrants hereby agree to Sponsor's and Administrator’s collection and usage of their personal information according to their privacy policies and acknowledge that they have read and accepted Sponsor's and Administrator’s privacy policies.
12) Disputes: Entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or the prize awarded and all issues and questions concerning the validity, interpretation and enforceability of these Official Rules shall be resolved individually, without resort to any form of class action, and exclusively in a court of competent jurisdiction sitting in Middlesex County, MA without regard for conflicts of law doctrine. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes and never shall include consequential, incidental or punitive damages, and in no event attorneys' or experts’ fees. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
13) For a Winners List — available on or about January 30, 2010, send a hand-printed, self addressed, sufficiently stamped, #10, business envelope to Winner —“Touchdowns for Technology” Sweepstakes, c/o Kaspersky Lab, 500 Unicorn Park, Woburn, MA 01801. Requests must be received by January 30, 2010. No mechanically reproduced or photocopied requests allowed; only one (1) request per outer mailing envelope. You cannot enter the Sweepstakes using this address. Entries mailed to this address will be discarded.
